Holy Flurking Schnitt! Court Opens Door To Searches Without Warrants. That's right folks, you're under arrest. That'll teach you to make eye contact with authority.

I admit I didn't read the whole whole case of USA v. GOULD, and it seems that the case on it's own may have merit, but one dissenting judge said it all with "I have no doubt that the deputy sheriffs believed that they were acting reasonably and with good intentions. But the old adage warns us that 'the road to hell is paved with good intentions.'" Any legal beagles care to shed some light on the potential reamifications?

  • Leaders in law enforcement say it will keep officers safe, but others argue it's a privilege that could be abused. its not a privilege. it is a violation of the united states constitution.
  • and while i'm at it, let me just say that all my fellow lefties, have won fight after fight over the last 50 years, the warren court, civil rights, miranda, keeping the government out of our pants (well, the important bits anyway, though my damn wallet keeps getting thinner), women in the workplace smashing the glass ceilings, a growing scorn for the religious mumbo-jumbo that keeps kids pregnant and incompatible adults committing homicides "of passion", and most of all: granting women control over their reproductive functions (rightwing translation: 50 million innocent babies murdered). yes, we've won these battles and the enemy has not overlooked this. they intend to get even, they intend to put this nation back where it was at the turn of the century, they intend to unfetter what they call "business" from "regulation" (so much the better to fleece the sinners), put the women back in the damn kitchenand by god if anybody even dares think about sex with an adolescent it had better be the damned mill foreman who can fire his/her daddy at will. cuz ya know, it worked that way for a thousand years and god hisself made it that way. point is, prepare: compassionate humanists have perhaps been a bit spoiled by thier nice long string of victory. there are plenty of pissed off neanderthals out there and the don't have much truck with the likes of no "constytooshuns." be vigilant. start saving for that kevlar.
  • Read the linked article..."The officers asked if they could look inside for Gould, and were allowed to enter." I think this ruling only applies to similar situations...the moral: Don't invite the cops into your house...ever!

  • I'm not a lawyer, but this seems a clear violation of the protections against search and seizure. What man proposes, the court disposes. Occasionally on appeal, but nevertheless.
  • In this case he signed a paper waiving his right to a warrant (??), but the implications are pretty ugly. As i read it, if a court officer feels threatened for whatever reason, the fourth amendment gets the boot while they tap dance on your laptop. Fortunately our illustrious SCOTUS will be able to put a stop to these activist judgeses in their unflagging support of truth and the constipation of the unnited staples.
