  • I am a bit surprised that she would file this suit prior to the criminal trial. She cannot possibly expect that the jurors will not have heard that she has done this. As such, all it will take is one single juror to think that she is doing this for the money. Though I would have previously bet my house that he would be found not guilty (the evidence is completely irrelevant), I now would bet my house and squidranch's, too.

  • The accuser's filing of a civil suit should not be surprising at all. It is very common to file a civil suit in addition to a criminal suit. Throughout the course of this particular case, the courts have badly handled evidence on at least three separate occasions, leaking the accuser's name, circumventing rape shield laws to allow her sexual history to be used against her, etc. The woman's attorney has speculated aloud on at least one occasion that they are considering dropping the criminal charges due to the "kangaroo court" feel of the proceedings. Since the burden of proof is less for a civil trial and the criminal trial seems to be a comedy of errors, it would make sense that (if indeed the woman was assaulted) she would seek SOME form of retribution. The OJ case mentioned above is a perfect example of this, in which the family thought that the jury overlooked a preponderance of evidence and ruled in favor of celebrity.

Forget the jury hearing about this, think the defense could now use this against her by showing the jury {an educated guess} her true intentions. The OJ case mentioned above is a perfect example of this The Brown family destroyed OJ's Hiesman Trophy instead of auctioning it off. The statue alone is a worth a lot to many football fans.

  • The whole thing has smelled fishy to me from the start. Kobe's obviously no saint, but I still think it was a setup. And if this does all turn out to be a load of crap, she will have done a great deal of damage to true rape victims.

That aspect of this case and others like it, not to mention "false" domestic abuse cases, almost makes it worse than if the defendant is guilty. Cases like that get a lot of media attention and can cloud the judgment of future juries because of it.

So, you know: entirely, competely, totally, indisputably and unarguably it is irrelevant as to her original motive for going to his room.
